Confidential Victims statements to Administrative Review to Advance Next Parole Hearing.
As Brittany’s Parent’s / Next of Kin and Victims of the inmate’s life crime on 10/10/1993. We have never missed a court date, hearing or any opportunity to be Brittany’s voice and advocate to keep everyone else safe from the inmate and for victims’ rights.
The inmate was known to us for a short period of time and rented a room for 6 weeks. He worked for a family friend/roommate Steve and was trust worthy to work at Thrifts Drug store. Steve knew him longer and was a store manager, the inmates boss and later became an acquaintance /friend.
The inmate was not ever seen with drugs or acted under the influence of drugs or alcohol at the house or work place. The work place also did drug testing per Steve. On a few occasions the inmate worked with myself (Darin) on electrical jobs for extra money to support his pregnant wife (separated) and year old child. We are not naïve people who have no clue nor would we put ourselves, our child, or our jobs in an unsafe home with the inmate if he was under the influence of drugs and or alcohol. Both Darin and I were raised in divorce homes and had alcoholic parents. The inmate has told different stories about his drug and alcohol use. In the last hearing 2023 (transcript p34) he was asked by Commissioner Nwajei When was the last time you used any kind of illicit substance? Inmate answered “um the last beer was October of 1993 uh any drugs I’ve done or be even before that or father back then that.”
This is just one example
Once again we are being re victimize in this process. We do not believe this inmate should be advanced only after 11 months of a 3-year denial. The inmate was moved shortly after the hearing to another prison. The inmate in all 3 hearing 2009, 2016 and 2023 used the excuses that either programs were full or they didn’t offer the program. So how could he now be ready in 6 months for a hearing while he has had to adjust in a new prison. He had no parole plans in 2023 in his risk assessment. His parole plans have been very dangerous and threating to multiple victim’s safety. He has been advised at 2 hearings of this issue and told to work on his plans. To this date he has not done that. He has no support in Los Angeles, San Bernardino, Riverside or Orange Counties. His victims live and work in these places. He said he has one cousin in Los Angeles but no support letters from him. Michelle (ex-mother in law / Victim of physical assault from inmate prior to life crime) has relationships with his family and said the only person left supporting him is his sister in FL who has in the past threaten multiple victims. We are in FEAR with his lack of support and parole plans that will put us and the public in danger if he was released. The inmates pre-sentencing report talks about his violence against women, pregnant women, elderly, children before his life crime of 3-year-old defenseless Brittany. There are statements made by inmate prior to life crime to multiple people about how he would kill someone. What is the scary part of these statements it is exactly how he killed Brittany? FYI there is a cold case in CO that is looking into inmate for his posable involvement prior to life crime. Inmate lived in CO and had a different name then. As again he has changed he story on why as an adult he changed his name.
In these past 3 hearings he told different stories on what happen the morning he killed Brittany. He has NEVER taken full responsibility. He has NEVER told the truth. He was asked in 2016 if he knew what the definition of REMORCE is and he could not answer the questions. He spent 16 years until his first parole hearing in 2009 blaming me (Jennifer) for killing Brittany and he made statements of being wrongfully charged and convicted. He also was not honest with his sister and she has threated Jennifer and Michelle over the years. He has NEVER made amends for these actions or acknowledge any INSIGHT of what this has done to us of all these 31 years.
